The Peruvian Tax Administration has established, through Legislative Decree 1312, a requirement that services received must undergo a Benefit Test, for which documentation and information must be provided to support the expenses deducted for such services.
The purpose of the Benefit Test Study is to verify the nature and actual provision of the services received from related parties. The Benefit Test Study must evaluate and verify, primarily, the following points:
- Compliance assessment: describes the existence and necessity of the service,
- Classification of services: classifies services as High Value or Low Value-Added.
- Reasonable allocation criteria: determine the costs and expenses incurred by the service provider, as well as the profit margin applied to high-value and low-value services.
